To Whom it may concern: Case Number- 11748400
On March 15th 2024 I Bishop Lensay Lee Bowling and George A Roberts brothers and minister partners of The Church of God of the Apostolic Faith spoke to Sarah Bowmer. I explained to her we needed a car for me to get back and forth to work at my full-time security job, to transport uber customers and to use for a church car. This would also be used to transport elderly free of charge to doctor appointment and back and forth to church.
I bought the 2010 Chevrolet Malibu Stock # 12536 4 door white car from Redhot Motors on Friday the 15th 2024. We gave you $2,000 down and the total price was 6,579.00 with taxes included.
With that said we took the car in good faith that it was a good car. We needed a good dependable vehicle for three reasons.
• Primary purposes. 1. To get me back and forth to work doing my security job.
• Secondly. To use it at my secondary job- Uber. In which I must have a dependable car to do this job.
• Lastly for the church to use for transporting the elderly back and forth to hospital, store, and doctor appointment. She never told us the car had any issues even though we asked her on several occasions.
After the paperwork was done George drove the car home a block from the dealership and the battery light came on. As we were pulling into the driveway, it quit in the road. We jumped it with our other vehicle and moments after taking the cables off, it would die again. We did this multiple times, but eventually got it in the driveway. We had intended to use the vehicle that night for a church service in Ohio but didn’t want to risk it. We called up to the lot and asked her about it and she said she had changed the battery already but would get me another one on Monday. I explained I had to work, and I needed something ASAP. She called auto zone and had her guy to put a new battery in the car. On Saturday the car started, and I did uber and the car made it 2 miles and it stalled out in a busy intersection and cost me a customer and a cancelled customer with a bad rating. This could have caused an accident that could have cost lives and DID cause me to obstruct traffic. This is unacceptable. Potential stopping problem on the highway the very day and the next day of buying the car is unacceptable. It took me hours to get it back to the driveway and it has been there since that time.
Unexpected stalling is a very dangerous problem and starting and quitting is not acceptable. I NEED HER TO FIX THE ISSUE TODAY or refund us our money.
We trusted you to sell us a car that was runnable and suitable for the road for we explained that we needed this car for church, work and uber purposes. One half hour after the paperwork we had nothing but issues with the car and I understand old cars have issues and that is fine. However, the day we buy it we have issues this is not good business. It is very dishonest.
The law is clear that the sale of any consumer product should guarantee that the product will perform at a level of quality that you would expect from another similar product. I have lost money from my one job already and had to call in on my other job. I am not the kind of person who sues but I have before and will again if this cannot be resolved. This is why I am seeking the help of the Attorney General’s office to assist in this matter.
This car meets the "lemon law" requirements, I do believe that we are entitled to obtain a refund or replacement car from the lot that is suitable for us, or you fix this current car. Indiana's “Lemon Law” (The Motor Vehicle. Protection Act) provides protection to us as buyers.
"Frankly speaking, I paid a lot of money for something dependable that is turning out to be a nightmare that is affecting my job and the safety of my passengers, and my attorney has said with the vehicle being unsafe you could be possibly Liable for deaths or injuries that would be caused because of the defective car due to the hazardous proposition it put us in. This car is the "worst" car I have ever driven, and I want to stress that its performance has been far from satisfactory.
Safety and performance were key in buying the car but so far this has been a nightmare effecting my livelihood and my name as a bishop on my job with my customer and I do not like to look bad to people who put their TRUST IN ME to get them to their designation. I'm convinced that Sarah and the car lot had acknowledged of the vehicle's shortcomings. Trust me, I understand. It is an older vehicle. I understand they all have some kind of issues with them, However DAY ONE of buying the car and Day Two have concerned me greatly. These issues have cost me money, time, reputation, and bad reports on my driver’s app with Uber. This is unacceptable. She has hijacked my job and those I serve from having proper transportation. This risked lives and put my job on the line. I now had to call off another night. If this continues, I will ask for loss of wages as well to be restored this is a time critical sensitive matter. I could become homeless not having a job and able to pay my bills.
I believe this is a dangerous car and somebody might get killed in it if it is not addressed. We cannot have a car that stalls in the middle of a major highway.
• The primary purpose of a car is to take you from Point A to Point B. If your vehicle regularly fails to start, that’s a problem the manufacturer needs to address.
• Power steering is critical for many large vehicles. If the steering doesn’t work, you aren’t getting the experience you expected when you bought the car.
• Glitching Electrical Systems: The infotainment system on modern cars is supposed to help you navigate and entertain your passengers, so glitches or failures can seriously affect how much your vehicle is worth.
The car has significant defects and needs to be fixed or a full refund issue. We have made several attempts to resolve this issue, but to no avail. I await your call or assistance in this matter at hand.
As prescribed by law, we are issuing a certified letter, effectively today, revoking and declining arbitration and seeking justice through the attorney general and the courts. This letter is date for 3/20/2024
